Staying on top of the legal and policy developments in the PFAS arena is no small task. Earlier this month, the U.S. Environmental Protection Agency (EPA) announced its final new drinking water standards under the Safe Drinking Water Act (SDWA) for six PFAS compounds. The EPA estimates that up to nearly a third of the U.S. population’s drinking water currently exceeds the PFAS Maximum Contaminant Levels (“MCLs”). With the implementation of the MCLs, public water systems (“PWSs”) nationwide providing approximately 105 million people with their drinking water must now sample for, monitor, and remove chemicals that, in most cases, require PWSs to install new treatment infrastructure. In this breaking news edition of the Monthly PFAS Briefing, we will discuss the ever-evolving landscape of PFAS regulation, with a focus on the SDWA, the MCLs, and the associated testing and treatment costs PWSs will soon face.
