Staying on top of the legal and policy developments in the PFAS arena is no small task. As a special service to our members, the Environmental Law Institute provides a monthly series of webinars with author of the PFAS Deskbook, James Pollack, and national experts on PFAS to keep you up to date, answer your questions, and highlight a unique topic related to PFAS during each session.
PFAS contamination has been at the center of thousands of personal injury cases. Few have garnered as much attention as the Ohio-based class action that would have put nearly every resident of Ohio in a class. In Hardwick vs. 3M, an Ohio firefighter named Kevin Hardwick successfully certified a class of Ohio residents with PFAS in their blood to consolidate personal injury claims regarding PFAS exposure allegedly caused by ten major chemical manufacturers. The Sixth Circuit summarily rejected this class certification on appeal in November of 2023. The litigation is still pending with a chance to reach all the way to the Supreme Court. This month’s session will be a discussion of the history of the Ohio personal injury suits against PFAS manufacturers and the legal arguments and strategies that plaintiffs employed. Additionally, we will discuss the larger issue of PFAS contamination nationwide and the role of tort litigation and regulation.
