Summary

On September 26, 1990, the Army Corps of Engineers announced in a Regulatory Guidance Letter its policy under §404 of the Federal Water Pollution Control Act regarding the regulation of wetlands in agricultural crop production. The Corps' position is an environmentally sound approach to the regulation of cropped wetlands, is fully consistent with the regulatory approaches of other federal agencies and with the views of many wetland scientists, and is likely to help diffuse some of the growing concerns among the farming community over federal regulation of cropped wetlands.
