Summary
On November 15, 1989, the U.S. Environmental Protection Agency and the U.S. Department of the Army finalized an historic Memorandum of Agreement on mitigation under the Clean Water Act §404 regulatory program. This was not the first such interagency agreement, nor was anything radical or new. It was historic because of the controversy and attention it generated both within the federal government and across the nation.
